1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and WebDigital (ABN: 17 453 778 242) ("we", "us", or "our"), concerning your access to and use of the fuelfinder.com.au website and the FuelFinder mobile application (collectively, the "Site").

By accessing the Site, you acknowledge that you have read, understood, and agreed to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the Site and you must discontinue use immediately.

2. Eligibility

The Site is intended for users who are at least 18 years old. Persons under the age of 18 but at least 15 years of age are permitted to use the Site only under the supervision of a parent or guardian who has agreed to these Terms. If you are a minor, you must have your parent or guardian read and agree to these Terms prior to you using the Site.

3. Account Registration

To access certain features, such as reporting petrol prices or saving favourite servos, you may be required to register an account. You agree to:

Provide accurate, current, and complete information during the registration process.
Maintain the security of your password and accept all risks of unauthorised access to your account.
Notify us immediately at [email protected] if you discover or suspect any security breaches related to the Site.

4. Petrol Price Data and Disclaimers

FuelFinder provides real-time petrol price comparisons from over 8,678 servos across Australia. While we strive to provide the most accurate data available, please note the following:

Accuracy: Petrol prices fluctuate rapidly. Prices are displayed in cents per litre (c/L). While we aggregate data from various sources and user reports, we do not guarantee that the price shown on the Site will match the price displayed on the bowser at the servo.
No Warranty: Use of the data is at your own risk. To the maximum extent permitted by the Australian Consumer Law, we provide the petrol price data "as is" and "as available" without warranties of any kind.
Reporting: Users may report petrol prices. You agree not to intentionally submit false or misleading petrol prices. Misuse of the reporting tool may lead to account termination.
Safe Driving: Do not use this Site or report petrol prices while operating a vehicle (including a car, ute, or motorcycle). Always comply with Australian road rules and ensure your mobile device is in a legal cradle or used hands-free if permitted.

5. Premium Services and Payments

The Site is free to use and supported by advertisements. We offer an optional "Premium" one-time purchase which removes ads and provides enhanced features.

Payment Processing: All in-app purchases are processed through RevenueCat and the respective app stores (Apple App Store or Google Play Store).
Currency: All prices for premium services are in Australian Dollars (AUD).
Refunds: Since premium features are delivered digitally and handled by third-party app stores, refunds are subject to the policies of Apple or Google. Nothing in this clause limits your rights under the Australian Consumer Law.

6. Permitted and Prohibited Use

You may use the Site to locate servos, check petrol prices, and navigate to stations for personal, non-commercial use. You may not:

Systematically retrieve data (scraping) from the Site to create or compile a collection, database, or directory without written permission from WebDigital.
Circumvent, disable, or otherwise interfere with security-related features of the Site.
Use the Site for any illegal purpose or in violation of any local, state, or federal law in Australia.

7. Intellectual Property Rights

Unless otherwise indicated, the Site, including its source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (the "Content") and the trademarks and logos contained therein (the "Marks") are owned or controlled by WebDigital (ABN: 17 453 778 242).

8. Third-Party Services

The Site utilises various third-party services to function effectively, including:

Analytics & Tracking: Google Analytics, Google Firebase, and AppsFlyer.
Advertising: Google AdMob.
Payments: RevenueCat, Apple App Store, and Google Play Store.

Your use of the Site is also subject to the terms and privacy policies of these third-party providers. We are not responsible for the content or practices of any third-party websites or services linked to from the Site.

9. Limitation of Liability

To the extent permitted by law, specifically the Competition and Consumer Act 2010 (Cth), WebDigital and its directors or employees will not be liable for any loss, damage, or expense—irrespective of the manner in which it occurs—which may be suffered by you due to your use of the Site or the reliance upon any petrol price information contained herein.

Our liability for breach of a condition or warranty implied by the Australian Consumer Law which cannot be excluded is limited to the supply of the services again or the payment of the cost of having the services supplied again.

10. Privacy

We care about data privacy and security. Please review our Privacy Policy. By using the Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms.

11. Indemnification

You agree to defend, indemnify, and hold WebDigital harmless from and against any loss, damage, liability, claim, or demand (including reasonable legal fees) made by any third party due to or arising out of your use of the Site, your contribution of petrol price data, or your breach of these Terms.

12. Governing Law

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of New South Wales and the Commonwealth of Australia. Any disputes arising in relation to these Terms will be subject to the exclusive jurisdiction of the courts of Australia.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will alert you about any changes by updating the "Effective Date" of these Terms. Your continued use of the Site after the date such revised Terms are posted implies your acceptance of the changes.

14. General Provisions

Severability: If any provision of these Terms is deemed unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions.
No Waiver: Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
